Telematics Privacy Notice

Novo Insurance, LLC (collectively, the "Company", "Novo Insurance", "we" or "us") is a wholly owned subsidiary of Telenav, Inc. (“Telenav”). We own, operate, and provide the website located at https://novo.us/ and any parent or child site (the "Site") and the Novo Insurance mobile application (the "Mobile Application"). We refer herein to the Site and Mobile Application collectively as the "Novo Insurance Platform".
This Telematics Privacy Notice sets forth the conditions that govern your use of the Novo Insurance Platform with respect to our collection and use of telematics data you authorize us to collect. Use of the Novo Insurance Platform is more broadly governed by the terms of our general Privacy Notice. By “opting in” to the collection of telematics information, you (a) accept how we collect, use, disclose and otherwise handle telematics information collected from you; and (b) represent and warrant you have the right, authority and capacity to accept these conditions.
If you do not agree with all conditions of this Telematics Privacy Notice do not consent to the collection of telematics information as part of the application process.
If you are accepting on behalf of a company or other third party, you represent and warrant that you have full authority to act for and to bind that company or other party, in which case the term "you" refers to that company or other party.
This Telematics Privacy Notice contains important information about Novo Insurance’s telematics (usage-based insurance) program. Please read this carefully and save with all your other policy forms.
DEFINITIONS
The following terms are defined and apply to this Telematics Privacy Notice only.
- “You” and “your” refer to all drivers enrolled in the “Program”.
- “Named Insured” means the individual or individuals listed under Named Insured on the declarations page.
- “Program” means the telematics Program.
- “App” means the Mobile Application.
I. Overview
The Program assists our policyholders to better understand their driving behaviour, develop safe driving habits, and improve safety. Customers voluntarily opt in to sharing their data while driving.
The Program gathers data using the Mobile Application and/or other related devices, including data directly from the vehicle.
II. Enrollment and Participation
Participation in the Program is strictly voluntary.
You must complete the following within 10 days of enrollment on an active policy:
- A. Provide a valid and active email address for a Named Insured and unique mobile phone numbers for all participating drivers;
- B. Enroll all active drivers in your household when participating in the Program, except those who are currently enrolled in the Program on another Novo Insurance policy or have completed the minimum logging period;
- C. Ensure that all enrolled drivers install and begin using the App; and
- D. Each driver must enable location services and motion permissions for the App.
Additionally, to continue to participate in the Program, even when you are not actively driving, you must:
- A. Keep the App on and running in the background with location services and motion permissions turned on until the minimum logging requirement is met;
- B. Maintain your insurance coverage at all times;
- C. Notify Novo Insurance of any changes that may affect this policy;
- D. Meet all other terms and conditions of the policy; and
- E. Adhere to the Terms of Use of the Program
Failure to satisfy these requirements may result in disqualification from the Program and loss of any applicable discounts.
III. Information We Gather
We gather the following information during enrolment and participation in the Program:
- A. Named Insured’s email address
- B. Your mobile phone numbers
- C. Information provided to Novo Insurance to start this policy
- D. The following data is gathered via the App and/or other devices including the vehicle, as you drive:
- Distance, using GPS location services and coordinates
- Mobile phone usage while driving
- Cornering
- Braking patterns
- Date and time of day
- Smoothness
- Speed
- Phone permissions
IV. How We Use the Information
The information logged and stored is used to help you develop safe driving habits and improve safety. The information gathered from each trip will be prepared by our technology partners and provided to Novo Insurance. For more information about the Program, visit https://novo.us/.
- A. Policy Rating. We will use your Program participation and telematics driving score in determining your premium.
- Participation. A discount is applied when a Named Insured enrolls in the Program. Provided you continue to use the App until the minimum logging requirement is met, the discount will remain on the policy through the first term. The Named Insured may opt out of the Program within the first 30 days, and the discount will be removed.
- Personalized Rating. Your policy will be adjusted to account for your telematics driving score at the renewal term after you meet the minimum logging requirement. The amount of the discount may be higher for drivers with better scores. Some policies with lower scoring drivers may include a surcharge. Personalized rating factors generally will not change after the initial logging period. After your telematics driving score is developed the Named Insured may request to restart the logging period, and any update to rating will be applied at the next renewal. Novo Insurance also may require that you restart the logging period in the future to update the personalized rate. A policy will not be declined, cancelled, or nonrenewed based on the telematics driving score.
- B. Claims. Driving information or data gathered by the App for each enrolled driver may be helpful in determining the cause of a loss. Therefore, Novo Insurance, at its discretion, may also review the data from the App as part of its investigation of an automobile accident. Additionally, information from the App may be sought by third parties, such as opposing parties in a civil lawsuit or by police when investigating the cause of an accident. Furthermore, Novo Insurance may be require to provide such information in response to a subpoena or as otherwise required by law.
- C. Research and Development. The following are examples of how Novo Insurance will use information gathered from the App:
- To improve the prices we charge for insurance;
- To improve our underwriting criteria and processes;
- To develop new insurance products and services that will encourage safe driving;
- To evaluate risk and analyse your driving habits;
- To provide to state insurance departments, on an aggregate and anonymized basis, to support Novo Insurance’s rates and filed underwriting guidelines; and
- To develop and improve the App.
V. Disclaimers, Warranties, Exclusions
We reserve the right to amend, waive, modify, or supplement the terms of the Program at any time for any reason.
We may terminate your participation in the Program at any time for any reason.
We may take adverse action against your policy for fraudulent use or other misuse of the App.
VI. Privacy
Protecting your privacy is very important to us. We take our obligation to safeguard and secure your personal information very seriously. Along with our technology partners, we follow strict data security and privacy protocols to protect your information and will not disclose information except as described herein and as described in the Novo Insurance Privacy Policy.
VII. Acceptance and Consent
By enrolling in the Program, installing the App:
- A. You accept this agreement and the Terms of Use of the App;
- B. The Named Insured agrees that they have the consent of each driver listed on the policy that information gathered through the App, including GPS location information if applicable, will be provided to us;
- C. You permit us to retain and use the information as described above and according to legal requirements for data retention; and
- D. You agree that you will not tamper with, modify, alter, change, disassemble, reverse engineer, copy, or duplicate in any manner the App or any other technology used to collect driver data. If it is determined that the App or technology has been tampered with, modified, altered, changed, disassembled, reverse engineered, copied, or duplicated in any manner by you, you will be removed from the Program and may be denied future participation in any other Novo Insurance program or offering. You also may be subject to legal action.
